3. Applicability

These General Terms and Conditions apply to every offer by Trader and every contract concluded between Trader and you.

4. Ordering and Contracting

  • By placing an order, you agree to these Terms and confirm you are 18 years or older with the legal right to use the selected payment method.

  • Your order constitutes an offer to purchase. Acceptance occurs only when we email confirmation of shipment or commencement of service.

  • We only deliver within South Africa.

  • For services, note that provision may be by third-party partners and subject to additional terms.

5. Withdrawal (Consumers Only)

  • You have 14 days to withdraw from a contract (unless exceptions apply).

  • For products: the period starts when you or your nominated third party (not the carrier) receives the product.

  • To withdraw, notify us in writing (post or email). We will confirm receipt.

  • Refunds will be processed within 10 days once goods are received or proof of return is provided.

  • You bear the cost of returns.

  • You may lose the right of withdrawal in cases including custom/personalised goods, perishables, hygiene-sensitive goods unsealed after delivery, or digital content once downloaded.

6. Delivery and Execution

  • Delivery shall be made without undue delay, and no later than 30 days for consumers.

  • Risk transfers to you once possession of the goods is taken.

  • We retain title until full payment is received.

  • Standard and expedited shipping charges are shown at checkout.

7. Price and Payment

  • Prices shown include applicable taxes.

  • In the event of a pricing error, we will notify you for approval of the corrected price.

  • Charges may appear on your statement as BRAND HUBB PTY LTD.

8. Warranty

  • Products are warranted against defects in compliance with manufacturer specifications and applicable law.

  • Services are warranted to conform to their description.

  • Misuse, accidents, or normal wear and tear are excluded.

  • Warranty returns are subject to each product’s specific warranty terms.

9. Liability

  • We are liable only for damages arising from intentional or gross negligence, defective products, or as required by law.

  • For consumers: we are liable only for foreseeable losses directly resulting from breach.

  • We are not liable for business-related losses (profit, business interruption, opportunity loss).

11. Assignment

  • You may not transfer this contract without our written consent.

  • Trader may assign the contract for business purposes provided consumer guarantees remain unaffected.

  • You submit to the non-exclusive jurisdiction of the South African courts.

  • Consumer rights under South African law override these Terms in case of conflict.
